This Privacy Statement describes Our policies and procedures on the collection, use, and disclosure of Your information when You use the Get Staffed Up Client Portal, and tells You about Your privacy rights and how the law protects You.

We use Your personal data to provide and improve the Service. By using the Service, You agree to the collection and use of information in accordance with this Privacy Statement.

Scope. This statement covers the Client Portal, https://myclientportal.getstaffedup.com, the password-protected application in which our clients view staffing information, invoices, billing details and support requests. The privacy statement for our public website, getstaffedup.com, is published separately. Cookies specifically are described in our Opt-out preferences page.

Interpretation and definitions

Interpretation

The words in which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in the plural.

Definitions

For the purposes of this Privacy Statement:

  • "You" means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service. Under the GDPR, You can be referred to as the Data Subject or as the User.
  • "Company" (referred to as either "the Company", "We", "Us" or "Our") refers to Get Staffed Up, LLC. For the purpose of the GDPR, the Company is the Data Controller.
  • "Service" refers to the Get Staffed Up Client Portal, together with the features and pages it makes available to You.
  • "Account" means a unique account created for You to access the Service or parts of the Service.
  • "Staffer" means a Get Staffed Up team member placed with, or presented to, Your organization through the Service.
  • "Service Provider" means any natural or legal person who processes the data on behalf of the Company. For the purpose of the GDPR, Service Providers are considered Data Processors.
  • "Personal Data" is any information that relates to an identified or identifiable individual.
  • "Cookies" are small files that are placed on Your computer, mobile device, or any other device by a website.
  • "Usage Data" refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself.
  • "Country" refers to the United States.

Collecting and using Your personal data

Personal data You provide

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You, including but not limited to:

  • First name and last name
  • Email address
  • Phone number
  • Company name and job title
  • Account password (stored only as a salted hash, never in readable form)
  • Two-factor authentication settings and recovery codes, if You enable them

Account and staffing data

Because the Service is a client portal, it also displays and processes data drawn from our staffing and billing systems of record, including:

  • Your organization's staffing roster, open positions, org chart and onboarding progress
  • Staffer profiles, schedules, time-off records and learning history
  • Invoices, invoice line items and billing history
  • Support tickets and the messages You send through the Portal or the support widget
  • Requests You submit, such as a payment method update or a referral

Billing and payment information

When You request a change to Your payment method, the Service does not collect Your bank or card details directly. It records Your request and triggers an agreement sent to You for electronic signature by DocuSign. The account details You enter are provided to DocuSign and passed to our finance team, not stored in the Portal.

To verify identity in connection with a payment or transaction, We may separately ask You for information such as date of birth, government-issued identification, a bank card statement, or other information linking You to an address. That information is requested outside the Portal.

Usage data

Usage Data is collected automatically when using the Service. It may include information such as Your device's Internet Protocol address (IP address), browser type and version, the pages of the Service You visit, the time and date of Your visit, the time spent on those pages, page load timings, unique device identifiers and other diagnostic data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, and the type of mobile internet browser You use.

If You consent to statistics cookies, session recordings and heat maps of Your interaction with the Portal are also collected. See Opt-out preferences.

Tracking technologies and cookies

We use cookies and similar tracking technologies to operate the Service and, where You consent, to analyze its use. You can instruct Your browser to refuse all cookies or to indicate when a cookie is being sent; however, because the Service requires You to sign in, refusing all cookies will prevent You from using it.

We use both session and persistent cookies for the purposes set out below:

Necessary / essential cookies

Type: session and persistent cookies. Administered by: Us. Purpose: these cookies authenticate You, keep You signed in, protect forms against cross-site request forgery, hold Your session state, and route Your requests to the correct server. Without these cookies the Service cannot be provided.

Type: persistent cookies. Administered by: Us. Purpose: these cookies record whether You have accepted the use of statistics cookies in the Service.

Functional third-party cookies

Type: session and persistent cookies. Administered by: third parties. Purpose: spam prevention on our registration form (Google reCAPTCHA), continuity of support conversations (Zendesk) and appointment booking (Microsoft Bookings).

Statistics and performance cookies

Type: session and persistent cookies. Administered by: third parties. Purpose: these cookies are used to understand how the Service is used and how quickly it performs. They are placed only after You consent, and You can withdraw that consent at any time.

Use of Your personal data

The Company may use personal data for the following purposes:

  • To provide and maintain our Service, including to monitor the usage of our Service.
  • To manage Your Account: to manage Your registration as a user of the Service and to give You access to the functionality available to You in Your role.
  • For the performance of a contract: the development, compliance and undertaking of the staffing services agreement You have entered into with Us.
  • To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication regarding updates or informative communications related to the functionalities, products or contracted services, including security updates.
  • To manage Your requests: to attend to and manage the support tickets, payment method updates and other requests You submit through the Service.
  • To provide You with news, special offers and general information about other goods, services and events that we offer that are similar to those You have already purchased or enquired about, unless You have opted not to receive such information.
  • To secure the Service: to detect, prevent and address fraud, abuse, and technical issues, and to keep diagnostic logs of application errors.

Retention of Your personal data

The Company will retain Your personal data only for as long as is necessary for the purposes set out in this Privacy Statement. We will retain and use Your personal data to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer.

Transfer of Your personal data

Your information, including personal data, is processed at the Company's operating offices and in any other place where the parties involved in the processing are located. The Service is hosted in the United States. This means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those of Your jurisdiction.

Your consent to this Privacy Statement followed by Your submission of such information represents Your agreement to that transfer. The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Statement.

Disclosure of Your personal data

Business transactions

If the Company is involved in a merger, acquisition, or asset sale, Your personal data may be transferred. We will provide notice before Your personal data is transferred and becomes subject to a different privacy policy.

Law enforcement

Under certain circumstances, the Company may be required to disclose Your personal data if required to do so by law or in response to valid requests by public authorities.

Security of Your personal data

The security of Your personal data is important to Us, but remember that no method of transmission over the internet or method of electronic storage is 100% secure. The Service is served over HTTPS, requires a confirmed email address to register, stores passwords only as salted hashes, and supports two-factor authentication. While We strive to use commercially acceptable means to protect Your personal data, We cannot guarantee its absolute security.

Detailed information on the processing of Your personal data

Service Providers have access to Your personal data only to perform their tasks on Our behalf and are obligated not to disclose or use it for any other purpose. The Service Providers used by the Client Portal are:

Microsoft Azure — hosting and infrastructure

The Service, its databases and its application logs are hosted on Microsoft Azure in the United States. Microsoft Privacy Statement

Workday — staffing system of record

Zendesk — support

Support tickets You raise through the Service, and the support widget embedded in it, are handled in Zendesk. An account is created for You in Zendesk so that You can follow Your tickets. Zendesk Privacy Notice

ActiveCampaign — contact and marketing automation

Your contact record is linked to our ActiveCampaign account, which manages our email contact database and automated messages. These services may also collect data concerning the date and time a message was viewed and whether You clicked links within it. Personal data collected: email address, name, custom fields. Twilio SendGrid — transactional email

Zapier and DocuSign — payment method agreements

Microsoft Bookings — scheduling

Email marketing

We may use Your personal data to contact You with newsletters, marketing or promotional materials and other information that may be of interest to You. You may opt out of receiving any, or all, of these communications by following the unsubscribe link or instructions provided in any email We send, or by contacting Us. Transactional messages relating to Your Account and Your contracted services cannot be opted out of while You hold an active Account.

Behavioral remarketing

We do not run advertising or remarketing tags inside the Client Portal. Your activity in the Portal is not used to target advertising to You on third-party websites. Remarketing described in the privacy policy for our public website applies to that website only.

GDPR privacy

Legal basis for processing personal data under GDPR

We may process personal data under the following conditions:

  • Consent: You have given Your consent for processing personal data for one or more specific purposes.
  • Performance of a contract: provision of personal data is necessary for the performance of an agreement with You.
  • Legal obligations: processing is necessary for compliance with a legal obligation to which the Company is subject.
  • Vital interests: processing is necessary in order to protect Your vital interests or those of another natural person.
  • Public interests: processing is related to a task carried out in the public interest or in the exercise of official authority vested in the Company.
  • Legitimate interests: processing is necessary for the purposes of the legitimate interests pursued by the Company.

Depending on where You live, You may have the right to know what personal information We collect, to request access to or deletion of that information, to request correction, to obtain a portable copy, and to opt out of the sale or sharing of personal information and of targeted advertising. We do not sell personal information for monetary consideration and we do not use Portal activity for cross-context behavioral advertising. Children's privacy

The Service is a business application intended for use by our clients' authorized representatives. It is not directed to anyone under the age of 18, and We do not knowingly collect personal data from children. If You believe a child has provided Us with personal data, please contact Us so We can remove it.

Our Service may contain links to other websites that are not operated by Us. If You click on a third-party link, You will be directed to that third party's site. We strongly advise You to review the privacy policy of every site You visit. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

We may update our Privacy Statement from time to time. We will notify You of any changes by posting the new Privacy Statement on this page, and We will let You know via email and/or a prominent notice in the Service prior to the change becoming effective, and update the "Last updated" date at the top of this Privacy Statement.
